US marriage green card: What couples must show USCIS to prove their marriage is genuine
By Aboki Forex —
Couples applying for a US marriage-based green card must convince US Citizenship and Immigration Services that their marriage is genuine and not entered into to obtain immigration benefits. USCIS examines whether couples entered their unions in good faith or primarily to obtain immigration benefits. A marriage certificate proves legal recognition. It does not, by itself, prove that the relationship is real.
USCIS officers assess whether couples genuinely intended to establish a life together when they married. The focus is on evidence of a shared life, not how romantic the relationship appears or how partners organise their household.
Start with the legal documents
Before submitting relationship evidence, applicants must provide a civil marriage certificate. They must also show that any previous marriages involving either spouse have legally ended. The petition must include proof that the sponsoring spouse is a US citizen or lawful permanent resident, as applicable.
Show shared finances and a shared home
Joint financial documents are among the strongest evidence. These include statements from joint bank accounts, shared credit card records and tax returns filed as a married couple. Insurance policies naming a spouse as a beneficiary can also help show long-term financial arrangements.
Evidence of a shared residence matters too. Couples can submit a jointly signed rental agreement, property deed, utility bills and official correspondence showing the same residential address. If a rental agreement contains only one spouse's name, a letter from the landlord confirming that both partners occupy the property may provide support.
Use affidavits and consistent records
Couples can also submit sworn statements from people familiar with their relationship, including relatives, friends, colleagues and religious leaders. Each affidavit should contain the writer's full name, address, date and place of birth. It should explain how the person knows the couple and what they know about the marriage. Statements describing specific interactions or events, with dates where possible, carry more weight than general declarations that the marriage is genuine.
The timing and consistency of documents can influence how officers assess an application. A couple whose joint bank account, insurance policy and rental agreement were all established shortly before filing may face additional questions. Providing a combination of older and recent records can help show that the relationship and shared commitments existed over time.
Applicants should ensure that information on their immigration forms matches the details in their supporting documents. Differences involving residential addresses, employment information or the dates they began living together could lead to requests for additional evidence or further scrutiny. Couples may also be required to attend an interview. Preparing copies of previously submitted documents and bringing updated evidence of their shared life can help them answer questions accurately and consistently.
USCIS wants genuine, well-organised evidence that reflects the actual relationship. A marriage certificate alone, or documents obtained shortly before applying, may not be enough.
